Resumen
The University as an object of study is a determinant in the development opportunities of nations in the knowledge society. The right to higher education establishes access to higher education based on merit (UN General Assembly, 1948). In view of this, it is important to establish how national education systems and universities establish methods to guarantee this meritocracy. The objective of this article is to analyze the state of contemporary art of legislation in Chile. The method used is documentary review and aims to recover and transcend the methods of selection and access to higher education, allowing to understand if the systems comply with what was stated in relation to education rights. In general, it is observed that the Latin American countries have implemented different mechanisms to guarantee inclusion, as well as that those who have access to the university have the expected performance.
