Resumen
The present work of a legal nature critically analyzes the patterns of application of indigenous custom by national courts, within a context of translocation of the Aymara community that inhabits northern Chile. It is proposed that the historical socio-cultural transformation processes that indigenous communities have undergone infuence their legal conscience by producing changes in the appreciation of their customary norms, an issue that is invisible in modern judicial practice. From this perspective, the application of the theory of principles in the Law is promoted to expand the tools of judicial interpretation, incorporating new cultural patterns into the customary character.
