Abstract
This article supports the thesis that Chilean criminal law cannot be considered an adequate response to the Mapuche cultural conflict due to a democratic deficit that the punitive system presents. Such a deficit is related to equality. Chilean criminal law responds only to the hegemonic vision of society, ignoring Mapuche interests and vision about the world and relations.
